These Terms of Service (the Terms) govern your use of the Ridewize iOS application and the services made available through it (together, the Service).

1. Who provides the Service

In these Terms, Ridewize, we, us, and our mean Ridewize GmbH. You means the person who creates or uses a Ridewize account.

2. The Service and these Terms

Ridewize is an iOS service intended for public-transport travel within Switzerland. It can detect and verify eligible commutes, create claims for points, and allow users to redeem points for offers, rewards, or vouchers. This document is the source of the Terms.

By selecting the acceptance action during registration or otherwise using the Service after being presented with these Terms, you agree to them. If you do not agree, do not create an account or use the Service.

Some offers, rewards, vouchers, partner locations, or campaigns have additional rules shown in the app or provided by a partner. Those specific rules apply in addition to these Terms. If they conflict with these Terms on an offer-specific matter, the more specific rule governs that matter, subject always to mandatory law. These Terms govern your relationship with Ridewize; a partner's terms may separately govern the partner's supply or fulfilment of a reward.

Our handling of personal data is described in the Privacy Policy. Acknowledging that policy is separate from accepting these Terms.

3. Eligibility and service territory

You must be at least 13 years old to create and use a Ridewize profile. We use your date of birth, among other things, to determine whether you meet the minimum age and may be eligible for particular offers.

If you are under 18, you may use the Service only to the extent that you can validly enter into and perform these Terms under Swiss law. Where the consent or approval of a parent or legal guardian is required, you must obtain it before using the Service. Ridewize does not represent that account registration itself constitutes or replaces any consent required by law.

You may not use the Service if applicable law prohibits you from doing so.

The Service is currently designed for eligible public-transport commutes within Switzerland. Detection, verification, points, and rewards may not work for travel outside the supported area. An iPhone, compatible iOS version, internet access for certain functions, and any other technical requirements described in the app may be necessary.

4. Your account

Registration uses your mobile phone number and a one-time code sent by SMS. A complete profile requires a valid email address, first and last name, username, and date of birth. You must provide accurate, current information and update it when necessary. You may not impersonate another person, use information you are not authorised to use, or create accounts to evade restrictions.

You are responsible for:

  • keeping control of the phone number and device associated with your account;
  • keeping authentication codes and account access confidential;
  • not allowing another person to use your account; and
  • promptly telling us at support@ridewize.io if you suspect unauthorised access, loss of control of your phone number, or another security issue.

You are responsible for activity through your account to the extent it results from your breach of these obligations or is otherwise attributable to you. This does not make you responsible for activity caused by Ridewize or for matters for which liability cannot lawfully be assigned to you.

You may not create or operate multiple accounts to obtain duplicate or otherwise unauthorised points, rewards, or vouchers. Phone authentication depends on the availability and correct operation of telecommunications providers, and SMS delivery can be delayed or fail.

5. Location permissions, commute detection, and verification

5.1 Your choice

You choose whether to grant location permission through iOS and may change that choice in your device settings. Ridewize's automatic commute detection currently depends on Always location access and Precise Location, including while the app is in the background. If you deny, limit, or later withdraw those permissions, location-dependent features may be unavailable or may not work reliably.

Granting location permission does not guarantee that tracking will always be active or successful. Device settings, battery restrictions, connectivity, operating-system behaviour, sensor quality, geographic coverage, and other technical conditions can affect the result.

5.2 How detection and verification work

Ridewize processes location signals to identify possible commutes and determine whether a journey or a portion of it appears to be eligible public-transport travel. Verification may use route, endpoint, stop, timing, distance, movement, and mode information, including route checks performed using Google Routes where applicable.

In normal operation, raw location evidence is processed and kept locally on your device for bounded commute processing. Endpoint, stop, derived trip, classification, and verification information may be sent to Ridewize's systems as needed to verify a commute, prevent duplicates, calculate rewards, and operate the Service. If you expressly choose to create and submit a commute-specific support package, it may include raw evidence for support review as described in the Privacy Policy.

5.3 No guaranteed detection or reward

Automated detection and classification are estimates. Ridewize does not guarantee that every journey will be detected, recorded, correctly classified, successfully verified, or eligible for points. A journey may be rejected or only its verified public-transport portion may qualify.

If you believe a commute was missed or processed incorrectly, contact support@ridewize.io and provide the information reasonably needed to investigate. Where available in the app, you may choose to submit a commute-specific support package. Submitting such a package is voluntary and requires your action or consent. A support review does not guarantee that a commute or reward decision will be changed.

6. Commute claims and points

6.1 Earning and claiming

When Ridewize verifies an eligible commute, the Service may create a claim for the number of points shown in the app. Points may be calculated from verified rewardable public-transport distance and may be rounded as shown in the app.

A pending commute claim must currently be claimed within 30 days after it is created. If it remains unclaimed at the end of that period, it expires and cannot be added to your points balance. The app may support claiming one or multiple pending claims. You remain responsible for completing the claim action before the displayed deadline.

Once points have been added to your points balance, these Terms do not impose a general expiry period on that balance. Particular rewards or vouchers obtained with points can nevertheless have their own validity or expiry periods.

6.2 Nature of points

Points are a limited feature of the Service. They:

  • are not money, electronic money, legal tender, a deposit, or a financial instrument;
  • have no cash value and cannot be exchanged for cash;
  • cannot be purchased through the currently offered Service;
  • are personal to your account and may not be sold, transferred, assigned, pooled, or traded; and
  • do not give you an ownership interest in Ridewize or any partner, or an unconditional right to a particular reward.

Points can be used only for offers made available in the app and in accordance with the rules shown there.

6.3 Errors, duplicates, and misuse

Ridewize may prevent or correct duplicate claims or redemptions and may correct a points entry that resulted from a documented technical, calculation, processing, or data error. We may also reverse points or a related reward where we reasonably determine, based on evidence, that they resulted from fraud, manipulation, materially inaccurate information, or a breach of these Terms.

Any correction will be proportionate to the identified error or misuse; this clause does not give Ridewize an unlimited right to confiscate points arbitrarily. Where reasonably practicable, we will explain a material adverse correction and give you a way to contact support. Mandatory legal rights remain unaffected.

7. Offers, rewards, vouchers, and partners

The offers displayed in the app control what can currently be redeemed, the required number of points, who is eligible, and any applicable restrictions. Offers may be limited by:

  • availability, inventory, or voucher-pool stock;
  • an offer, campaign, wallet, or voucher validity period;
  • age or other eligibility conditions;
  • participating partner locations, opening times, or geographic limits;
  • permitted products or services, exclusions, and redemption method; and
  • single-use, prior-use, consumed, expired, revoked, or other redemption status.

Read the complete offer details and partner-specific terms before spending points and again before attempting redemption. It is your responsibility to check that you meet the restrictions and can use the reward at an eligible partner location before it expires.

The Service supports different redemption methods, including vouchers allocated from a pool and vouchers that require a manual redemption step. Follow the instructions shown in the app. A code, voucher, or redemption screen may be single-use and may become invalid once consumed. Do not copy, sell, transfer, alter, or reuse it.

Offers can sell out or become unavailable before redemption is completed. A reward shown in the app is not guaranteed until the Service confirms the relevant redemption and adds the resulting item to your wallet. Once issued, a reward or voucher remains subject to its displayed validity, state, and restrictions.

Partners are responsible for the products, services, locations, and fulfilment they provide under their applicable terms. Ridewize is responsible for operating its own Service and for any obligations that mandatory law places on Ridewize. Nothing in these Terms excludes or limits responsibility where Swiss law does not permit that result.

If a voucher or redemption does not work as described, do not repeatedly attempt a one-time redemption. Contact support and, where relevant, the partner so the issue can be investigated.

8. Acceptable use

You must use the Service lawfully and for its intended personal purpose. You must not:

  • submit fabricated, replayed, altered, automated, or misleading location, trip, profile, support, or redemption information;
  • claim the same commute or redeem the same reward more than once, or help another person do so;
  • manipulate device settings, software, accounts, routes, vouchers, points, or verification systems to obtain an unauthorised benefit;
  • sell, transfer, share, scrape, harvest, or commercially exploit accounts, points, vouchers, Service data, or access to the Service;
  • access another person's account or non-public parts of the Service without authorisation;
  • introduce malware, overload, disrupt, damage, probe, or circumvent the Service or its security, rate limits, or access controls;
  • reverse engineer, decompile, disassemble, or attempt to derive source code from the Service, except to the limited extent that applicable law expressly permits this despite a contractual restriction;
  • infringe intellectual-property, privacy, personality, or other rights; or
  • use the Service for unlawful, fraudulent, abusive, threatening, or harmful conduct.

You may report suspected security vulnerabilities to support@ridewize.io. Do not exploit a vulnerability or access other users' data.

9. Suspension, termination, and account deletion

9.1 Action by Ridewize

Ridewize may restrict or suspend affected functionality or account access where reasonably necessary to:

  • investigate suspected fraud, abuse, unauthorised access, or a material breach of these Terms;
  • protect users, partners, Ridewize, or the security and integrity of the Service;
  • comply with law, a binding authority request, or a partner restriction affecting a particular reward; or
  • address a serious technical or operational risk.

Ridewize may terminate an account for a material or repeated breach, confirmed fraud or abuse, legal necessity, or where continuing the account would create a material security risk. Except where immediate action is reasonably necessary, unlawful, or would undermine an investigation, we will provide reasonable notice and an explanation and, where appropriate, an opportunity to remedy the issue or contact support. Measures will be proportionate to the reason for them.

9.2 Deletion by you

You can request permanent account deletion through the app. The deletion flow removes the Ridewize account and authentication account data and clears account-related local tracking state and queues from the app. For details about personal-data deletion and any information Ridewize may be legally required or permitted to retain, see the Privacy Policy.

Deletion is intended to be permanent. You may lose access to pending commute claims, your points balance, wallet items, unused or unredeemed rewards, and account history when the account is deleted. Do not delete your account if you still intend to use them. The Service does not currently support transferring these items to another account or converting them to cash. Any rights that mandatory law requires to survive deletion remain unaffected.

9.3 Effect of termination

When an account ends, your licence to use the Service ends. Provisions that by their nature should continue—including provisions on intellectual property, point and reward restrictions, liability, governing law, and dispute resolution—remain applicable. Termination does not affect rights or obligations that arose before termination.

10. Intellectual property and licence

The Service, including its software, design, text, graphics, branding, databases, and other content, is owned by or licensed to Ridewize and is protected by intellectual-property and other laws. Partner names, logos, and content belong to their respective owners.

Subject to these Terms, Ridewize grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to install and use the app on an iOS device you own or control, solely to use the Service for its intended non-commercial purpose. No other rights are granted.

If you send feedback or suggestions, you permit Ridewize to use them without restriction or payment, but this does not transfer ownership of your personal data or content you provide for support.

11. Third-party services and Apple

The Service relies on third parties, which may include Apple platform and App Store services, telecommunications and SMS providers, hosting and authentication infrastructure, route-verification services such as Google Routes, and reward partners. Their systems and terms may affect availability or particular functions. Ridewize remains responsible for its own obligations and for its choice and use of service providers as required by applicable law.

Your use of the iOS app must also comply with applicable Apple Media Services and App Store terms. Apple is not a party to these Terms and is not responsible for providing the Service, support, rewards, or partner fulfilment, except for any obligations Apple has under its own terms or mandatory law.

12. Availability and changes to the Service

We aim to operate the Service with reasonable care, but continuous, uninterrupted, secure, or error-free availability cannot be guaranteed. Maintenance, updates, device or network conditions, third-party outages, security incidents, and events outside reasonable control can interrupt or limit the Service.

Ridewize may improve, update, replace, or remove features, supported iOS versions, verification methods, reward calculations, or offers. We may also discontinue the Service. Where a change materially disadvantages existing users, we will provide reasonable advance notice where practicable and explain the effect on accounts, points, and issued rewards. We will not use this clause to avoid obligations already owed under mandatory law or confirmed redemptions.

You may need to install updates to continue using the Service safely or correctly.

13. Warranties and liability

Ridewize will provide the Service with the care reasonably expected under the circumstances and will honour any warranties or remedies that cannot be excluded under Swiss law.

The Service uses automated and third-party-dependent processes. Subject to mandatory law, Ridewize does not warrant that every commute will be detected or verified, that every classification or estimate will be exact, that a particular offer will remain available, or that the Service will be uninterrupted.

Each party is liable according to applicable Swiss law. To the extent permitted by law, Ridewize is not liable for loss caused solely by:

  • your breach of these Terms, unlawful use, or manipulation of the Service;
  • inaccurate information you supplied;
  • your failure to follow displayed reward restrictions or redemption instructions; or
  • a third-party service, partner, device, network, or event outside Ridewize's reasonable control that Ridewize could not reasonably have prevented.

Nothing in these Terms excludes or limits liability for intent or gross negligence, death or personal injury, fraudulent conduct, breach of mandatory data-protection duties, or any other liability or consumer right that cannot lawfully be excluded or limited. Any limitation in these Terms applies only to the extent valid under Swiss law.

14. Changes to these Terms

Ridewize may update these Terms when reasonably necessary to reflect changes in the Service, law, security requirements, or business operations. We will make the updated Terms available and give reasonable advance notice of material changes through the app, by email, or by another appropriate channel.

If a material change requires renewed acceptance under applicable law, we will request it before the change applies to you. Otherwise, the updated Terms will apply from the date stated in the published version. Changes will not retroactively remove accrued rights unless permitted by mandatory law. If you do not agree to an update, you may stop using the Service and delete your account before it takes effect.

15. Notices and communications

Ridewize may send service-related notices through the app, to the phone number or email address associated with your account, or by publishing a notice where legally appropriate. You must keep your contact information current. Electronic communications satisfy a written-notice requirement to the extent permitted by law.

16. Governing law and venue

These Terms and your use of the Service are governed by substantive Swiss law, excluding its conflict-of-laws rules.

The courts at Ridewize's registered seat have jurisdiction, but only to the extent that applicable law permits that venue. Any mandatory venue available to you as a consumer—including a venue at your domicile where required by Swiss law—remains unaffected.

17. General provisions

If a provision of these Terms is invalid, unlawful, or unenforceable, the remaining provisions remain in effect. The affected provision will be applied or replaced only to the extent necessary to achieve a lawful result that most closely reflects its purpose, subject to mandatory law.

Ridewize's delay in enforcing a right is not a waiver of that right. You may not assign your account or rights under these Terms without Ridewize's consent. Ridewize may transfer these Terms as part of a merger, reorganisation, financing, or transfer of the Service, provided that doing so does not reduce mandatory rights and users receive notice where required.

These Terms, the Privacy Policy, and any applicable offer- or partner-specific terms form the agreement governing the Service. They do not limit rights that cannot be waived under Swiss law.
